Abstract
A transaction with oneself occurs when a person represents another and sells the property that he represents on behalf of another and transfers it to himself as the original buyer. In this transaction, there is a contracting party with two credit titles: buyer and seller. Famous jurists believe that this transaction is valid. Among the options specific to sale is the parliamentary option, which has some ambiguities in proving that it is based on the plurality of buyers and is not subject to their differentiation (the seller has the option of not being differentiated) in a transaction with oneself, which is due to the lack of plurality of buyers and the impossibility of realizing the differentiation of the interlocutors in this transaction. Some, citing reasons, believe that the parliamentary option does not apply in a transaction with oneself. In this research, which was prepared using a descriptive-analytical method and using library resources and related software, it sought to prove the flow of the parliamentary option in a transaction with oneself and the conclusion was reached that firstly, by accepting the plurality (variation) of the credit of the buyers And considering the spiritual difference between them, the choice of the assembly in dealing with itself can be considered fixed. Secondly, there are general and general rules such as the rule of necessity and hindrance, the necessity in permission, the refinement of conditions, and the way of the wise, which, regardless of the number of followers, prove the choice of the assembly in dealing with itself.
