Since it is always possible that these technical and complex measures or instruments get abused by the state or citizens and due to the possibility of disordering at due process of the use of power, it is necessary to determine the conditions and rules for exercising such measures and for the resulting responsibilities. However, the unclear and incomprehensive approach of the legislature toward the legal nature of these preventive measures and their using conditions, have provided the opportunities for abusing and caused disagreements among lawyers and scholars. Some believe that these kinds of measures are self-defense and are subject to its conditions and rules. But some others regard them as some kinds of absolute and exclusive ownership rights. This article, relying on the jurisprudential and legal bases of the right of using these preventive measures and drawing on judicial precedents, doctrines, and different rules, investigates the nature and conditions of these measures and responsibility arising from using these kinds of measures. پیشگیری وضعی مجموعه تدابیر و اقداماتی است که دولت و جامعه مدنی با استفاده از آن سعی می­کند از طریق افزایش زحمات و خطرات ارتکاب جرم و کاهش فرصت­ها و موقعیت­های جرم­زا و تقویت سیبل­ها و آماج­های جرم به جلوگیری از جرم بپردازد.با عنایت به امکان سوءاستفاده از این اقدامات و ابزارهای فنی و پیچیده توسط شهروندان  و دولت و امکان اخلال در فرایند اعمال صحیح حاکمیّت، تعیین شرایط و ضوابط برای اعمال این نوع اقدامات پیشگیرانه و مسئولیّت ناشی از آن امری ضروری است. با وجود این، نظر به عدم شفافیت و جامعیت رویکرد  قانونگذار در باب ماهیّت، شرایط اقدامات پیشگیرانه و مسئولیت ناشی از آن زمینه برای سوءاستفاده‌ها و اختلاف‌نظرها فراهم گردیده است. برخی معتقدند اعمال این اقدامات نوعی دفاع مشروع بوده و تابع شرایط و احکام آن می‌باشد، برخی هم آن را نوعی اعمال حق مالکیت به صورت مطلق و انحصاری می‌دانند. مقاله حاضر با تکیه بر مبانی فقهی و حقوقی حقّ استفاده از اقدامات پیشگیرانه­ وضعی و با الهام از رویه‌های قضایی، دکترین فقهی و حقوقی و قوانین و مقررات مختلف ضمن تبیین این دیدگاههای متفاوت به بررسی ماهیت، شرایط و مسئولیت ناشی از اعمال این نوع اقدامات می‌پردازد. https://jjfil.ut.ac.ir/article_65685_62fe5d65befaf2c6565577695e3a89ec.pdf
