Subjects such as the responsibility of council members for the executive affairs have made some people doubt about identifying the aforementioned function in council institutions. Therefore, the question arises as to whether we can recognize this function for the Council institution or not? Using the legal and jurisprudence sources and rules in this field, this study investigates the councils’ executive function and stating the issues brought up in that field, employing descriptive-analytic approach. The result of the study was as follows: in jurisprudence sources, some executive functions for the council such as council competence of the selection of Muslim ruler, has been established and provided. Similarly, in the legal system of Islamic Republic of Iran, this function has been established in many cases such as former Supreme judicial council, local council, and administrative councils in accordance with constitution and regulations. Dealing with this issue, the guardian council has also viewed it with caution. But what is indisputable, is the council’s competence in this field. کارکرد اجرائی و بازیگری نهاد شورا در این عرصه یکی از موضوعات مطرح در ارتباط با نهاد مزبور است. مباحثی همانند نحوه مسئولیت اعضای شورا در قبال امور اجرایی سبب شده است برخی در شناسایی کارکرد مزبور برای نهادهای شورایی تردید نمایند و بدین ترتیب این پرسش مطرح می‌شود که آیا می‌توان نهاد شورا را برخوردار از کارکرد اجراء دانست یا خیر؟ نوشتار حاضر با رویکردی تحلیلی ـ توصیفی و با استفاده از منابع حقوقی و فقهی و قوانین موجود در این زمینه به بررسی و تبیین کارکرد اجرائی برای نهاد شورا و بیان موضوعات مطرح در این رابطه می‌پردازد. نتیجه حاصله از این پژوهش بدین شرح است که در منابع فقهی برخی کارکردهای اجرائی برای شورا همانند انتخاب حاکم اسلامی پیش‌بینی و مقرر شده است. در نظام حقوقی جمهوری اسلامی ایران نیز، این کارکرد در موارد متعددی برای مصادیق نهاد شورا مطابق اصول قانون اساسی و قوانین عادی برای شوراهایی همچون شورای عالی قضائی سابق، شوراهای محلی و شوراهای اداری مقرر شده است. شورای نگهبان نیز در برخورد با این مسئله با احتیاط به این کارکرد نهاد شورا نگریسته است. اما آنچه مسلم است، وجود صلاحیت نهاد شورا در این عرصه می‌باشد. https://jjfil.ut.ac.ir/article_65680_6f7fa0eab9cda91d5e00e1a85dfa7926.pdf
