There is a disagreement whetherdispute over juristic problems is lawful, for Shari‘a has aconstant connection with individuals and social life. Theresult of dispute over Shari‘a would be conflict andseparation in the social life and this makes differences ofopinions in juristic problems unlawful. On the contrary,there is a perspective which on the one hand considersunity of opinions impossible because of differences ofindividuals, environments, and perceptions and on theother hand treats unity of opinions undesirable; hence,defends desirability of differences in opinions as tojurisprudence and precepts and considers it lawful. Thelatter relies on verses 78 and 79 of sura 21 which denotedifferences of two contemporary prophets in judging oneparticular case and, declaring differences of levels ofknowledge as well as abilities of prophets, considersdisagreement of judgments of prophets a practical patternfor social life; it treats scholarly disagreements of scholarsin jurisprudence and precepts as the custom of scholars,comments on those two verses, and defends disagreementsbased on ijtihad – but negates disputes based on rebellionand mutiny.}, keywords = {idjtihad,Disagreement,legitimacy,opinion,Judgment}, title_fa = {اختلاف اجتهادی از نظر قرآن (تفسیر آیه‌های 78 و 79 سوره انبیاء)}, abstract_fa = {عملیات اجتهادی در حوزۀ فقه و شریعت، منتهی به اختلاف آراء می‌شود، نسبت به جواز اختلاف در شرعیات، اختلاف دیدگاه وجود دارد؛ زیرا شریعت با زندگی افراد و حیات اجتماعی رابطۀ ناگسستنی دارد. سرانجام اختلاف در شریعت، تنازع و شقاق در حیات اجتماعی خواهد بود و با این استدلال، اختلاف در حوزۀ شرعیات را ممنوع می‌دانند. در مقابل این نظریه، دیدگاهی وجود دارد که رسیدن به وحدت نظر را به علّت تفاوت‌های فردی و محیطی و ادراکی ناممکن می‌داند و اتّفاق‌نظر در فقه و شرعیات را مطلوب نمی‌داند و از مطلوب بودن اختلاف آراء در فقه و شرعیات دفاع کرده و آن را مجاز می‌شمرد. مستند این نظریه، آیه‌های 78 و 79 سورۀ انبیاء است که دلالت بر اختلاف دو پیامبر هم عصر در قضاوت و داوری نسبت به یک قضیه می‌کند و با بیان اینکه مراتب علم و توانمندی انبیاء متفاوت است، وجود اختلاف در داوری‌های پیامبران را الگوی عملی برای حیات اجتماعی تلقّی کرده و اختلاف علمی در فقه و شرعیات را سیرۀ علماء دانسته است و به تفسیر آیه‌های مذکور پرداخته، از جواز اختلاف اجتهادی دفاع کرد؛ امّا اختلاف مبتنی بر بغی و سرکشی را نفی نمود.}, keywords_fa = {اجتهاد,اختلاف,مشروعیت,رأی و حکم}, url = {https://jjfil.ut.ac.ir/article_36691.html}, eprint = {https://jjfil.ut.ac.ir/article_36691_3a05945f088552cd9f9eabed486c69d8.pdf} }
